These Terms of Service govern your use of markoathletics.com and any purchase you make from it. In these terms, "Marko Athletics", "we", "us" and "our" mean Marko Athletics, and "you" means you. The store is powered by Shopify, which enables us to provide it to you.

By using this site or placing an order you agree to these terms and to our Privacy Policy. If you do not agree to them, please do not use the site.

1. Who can order

You must be the age of majority in your state, province or country to place an order. You confirm that the information you give us, including email, billing, shipping and payment details, is accurate, and that you are authorised to use the payment method you provide.

2. Our products

We publish real garment measurements, flat, in inches and centimetres on every product page, and we would rather you check them than guess. Colour and appearance can still differ from your screen depending on your device and its settings.

Our garments are produced in batches. Small differences in fabric, dye and finishing occur between production runs. That is normal in apparel and we would rather say so than pretend otherwise.

We may change or discontinue any product at any time, and we may limit quantities per person, per household, or per drop. Numbered and capped releases are limited deliberately, and once a run is sold it does not reopen.

3. Orders

Placing an order is an offer to buy. Your order is accepted when we confirm it and your payment has been processed. We may decline or cancel an order, including for suspected fraud, pricing errors, or stock we cannot fulfil, and if we do we refund you in full and tell you why.

Items are made to order once your purchase is confirmed. If you need to cancel, email us as soon as possible: we will cancel and refund in full if production has not started. Once an item is in production we cannot stop it, but your rights under our Return and Refund Policy still apply.

Your purchases are for your own personal use, not for commercial resale.

4. Prices and payment

Prices are in US dollars and may change without notice. The price that applies is the one shown when you place your order, as confirmed in your order confirmation email. Posted prices exclude taxes, shipping, and any customs or import charges, which are shown at checkout or explained in our Shipping Policy.

If a product is listed at an obviously incorrect price because of a technical or human error, we may cancel the order and refund you rather than honour the error. We will contact you first.

5. Shipping, delivery and risk

Delivery estimates are estimates. We are not liable for delays caused by carriers, customs processing, or events outside our control. Title and risk of loss pass to you when the goods are handed to the carrier. If a parcel is lost or damaged in transit, see our Shipping Policy, because we will still make it right.

6. Returns

Returns and exchanges are governed by our Return and Refund Policy, which forms part of these terms. Nothing in these terms limits any statutory rights you have as a consumer.

7. Intellectual property

The Marko Athletics name, the two-peak mark, our logos, product names, designs, photography, copy and the arrangement of this site are owned by Marko Athletics or our licensors, and are protected by copyright, trade mark and other laws. You may use the site for your own personal, non-commercial use. You may not copy, reproduce, republish, sell, or create derivative works from our content or designs without our written permission.

8. Your content and feedback

If you send us ideas, reviews, photographs or other content, you grant us a worldwide, royalty-free, sublicensable licence to use, reproduce, modify and display it, including for marketing. You confirm you own it or have the rights to it, that it does not infringe anyone else's rights, and that it is not unlawful, abusive or obscene. We are not obliged to keep it confidential, pay for it, or respond to it, and we may remove it.

9. Acceptable use

Use the site lawfully. Do not use it to break the law, infringe anyone's rights, harass or abuse anyone, transmit false information, distribute spam or malware, impersonate anyone, scrape or harvest data, or bypass our security measures. We may suspend or terminate access if you do.

10. Third-party links and tools

The site may link to or embed third-party services. We do not control them, we provide access to them as is and without warranty, and we are not responsible for them. Review their terms before you use them.

11. Relationship with Shopify

This store is powered by Shopify, which enables us to provide it to you. Any sale or purchase you make is made directly with Marko Athletics. Shopify is not responsible for any aspect of a sale between you and us, including any injury, damage or loss resulting from products purchased, and you release Shopify and its affiliates from claims arising from your transactions with us.

12. Disclaimer of warranties

Except as expressly stated by us, the site and the products offered through it are provided as is and as available, without warranties or conditions of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement. We do not warrant that the site will be uninterrupted, timely, secure or error-free. Some jurisdictions do not allow these exclusions, so they may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, neither Marko Athletics nor our directors, officers, employees, affiliates, agents, contractors, service providers or licensors will be liable for any indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue, lost savings or loss of data, arising from your use of the site or any product purchased through it. Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

14. Indemnity

You agree to indemnify and hold harmless Marko Athletics, Shopify, and our respective affiliates, officers, directors, employees, agents and licensors from any claims, losses, damages or liabilities, including reasonable legal fees, arising from your breach of these terms, your violation of any law or third-party right, or your use of the site.

15. Termination

We may terminate your access to the site at any time. Sections that by their nature should survive termination, including intellectual property, feedback, disclaimers, limitation of liability, indemnity and governing law, will do so.

16. Severability, waiver and entire agreement

If any provision is found unenforceable, it is severed and the rest remains in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the policies referenced in them, are the entire agreement between us and supersede any prior agreements.

17. Assignment

You may not assign or transfer these terms without our written consent. We may assign them without notice.

18. Governing law

These terms are governed by the laws of the State of Florida, United States, and you and we consent to the jurisdiction of the state and federal courts located there. This does not deprive you of the protection of mandatory consumer law in your country of residence.

19. Changes

We may update these terms. The current version is always on this page, with its date at the top. Material changes take effect as notified. Continuing to use the site after a change means you accept it.
